Penn Mill Lakes Subdivision (proposed class action) |
|
CALENDAR OF UPCOMING MEETINGS AND EVENTS · We will be scheduling a meeting of the homeowners of the Penn Mill Lakes Subdivision very soon. · It appears that we will not be able to meet on November 22, 2008, either. We apologize for this inconvenience, but it was out of our hands. We are assured that the meeting will move forward on SATURDAY, DECEMBER 6, 2008. We will post the place and time here and send out an email to anyone who wants notice of the meeting. · We are putting together a list of homeowners interested in the suit. We will use this information only to send you notices of meetings and important events in the case. If you would like us to send you notices of meetings and/or important events in the case via email and/or regular “snail” mail, please contact Adam Lambert by email.
ABOUT THE CASE · Purchasers of property in a newly-built subdivision suffered serious drainage issues which impeded access to their homes and affected their property values. · The class alleges that the drainage system in the subdivision was poorly designed and poorly built and the entire system needs to be redesigned and rebuilt. · Mr. Lambert, along with his co-counsel, Maurice LeGardeur, Louis R. Koerner, Jr., and Emery Voorhies, filed suit on behalf of all of the homeowners in the subdivision to compel the subdivision developers to remedy the drainage issues and restore the plaintiffs’ property to full use. · The class has not yet been certified and we are currently looking to speak with anyone who was or is a homeowner in the Penn Mill Lakes Subdivision. If you own a home or lot in the subdivision, please contact us today without charge or obligation to discuss your options. · We have received several emails from homeowners in the subdivision regarding the drainage issues on their property. We are pleased that homeowners are checking the website and keeping us informed. The information and support you have provided has been invaluable to us. Remember that this is YOUR suit and we are fighting for YOUR property. Your assistance and input is necessary, welcomed, and much appreciated. |

RICHARD GRANT, ET AL (PROPOSED CLASS ACTION)
VERSUS
SUN CONSTRUCTION, LLC, ET AL.
22ND JUDICIAL DISTRICT COURT FOR THE PARISH OF ST. TAMMANY NO. 2008-11536, SEC. “H”
CASE ISSUES & AREAS OF LAW:
· Class Action Suits · Property Rights · Subdivision Engineering · Drainage Issues |
|
PLEADINGS & ORDERS OF THE COURT · Read the Original Class Action Petition filed by us on March 20, 2008. · Read the Memorandum in Support of Motion to Certify Class filed by us on June 6, 2008.
PROGRESS OF THE CASE · The Motion to Certify Class, which is posted above, is still pending. The motion seeks to have our lawsuit certified by the Court as a class action. · It appears that we will win our fight to have this lawsuit consolidated with two previously-filed individual suits over this same drainage issue. Once the consolidation issue is fully decided—which should be soon—the Court will focus on our class certification motion and our outstanding discovery requests.
